1. Agreement

These Terms of Use ("Terms") govern your access to and use of supercomputing.news and any related services we operate (collectively, "SCN" or the "Service"). The Service is operated by Supercomputing News, LLC, a Washington limited liability company.

By accessing the Service, creating an account, subscribing, or accessing our API, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

2. Plain-English Summary

  • You can read free articles without an account. Paid subscriptions unlock paywalled coverage and the full archive.
  • You can't republish our work without permission. Personal sharing of links and short quotes is fine.
  • You can't use our content to train AI models without a license. Our paid API is the only authorized machine-readable channel.
  • Subscriptions auto-renew. You can cancel anytime; we don't pro-rate refunds for partial periods.
  • Our API uses on-chain micropayments. Once a payment settles on-chain, it's final. The API request is delivered as-is.
  • We can change or discontinue the Service. We'll give reasonable notice for changes that materially affect paid subscribers.

3. Eligibility

You must be at least 16 years old to use the Service. SCN is a B2B trade publication and is not directed at children. If you are accessing the Service on behalf of an entity, you must have legal authority to do so.

4. Accounts

You can browse free content without an account. Subscriptions, newsletters, and API access require registration.

  • Accuracy. Provide accurate, current information when you register.
  • Security. You are responsible for keeping your credentials secure and for all activity under your account, including any magic-link tokens, API keys, or connected wallets.
  • One account per person. Account sharing is not permitted under personal subscriptions. Team and enterprise access is available; contact us.
  • Notify us of compromise. Email us promptly if you believe your account or wallet has been compromised.

We may suspend or terminate an account that violates these Terms, that we reasonably believe is being used fraudulently, or that has been inactive for an extended period.

5. Subscriptions, Billing, and Cancellation

5.1 Plans and pricing

Current subscription plans, prices, and included features are posted on the Service. We may change pricing or plan features prospectively; changes will not affect the current paid term of an existing subscriber.

5.2 Payments

Subscription payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method for the subscription fee and any applicable taxes.

5.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period at the then-current rate, unless you cancel before renewal. You can cancel from your account settings.

5.4 Refunds

Subscription fees are non-refundable except where required by law. If you cancel mid-period, you retain access until the end of the paid period; we do not pro-rate refunds.

5.5 Failed payments

If a renewal payment fails, we may retry the charge, suspend paid access, and ultimately terminate the subscription. You remain responsible for amounts owed for any period during which you had paid access.

5.6 Taxes

Prices shown are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or similar charges imposed on your subscription.

6. API Access and x402 Micropayments

SCN offers programmatic access to selected content via a paid API using x402 micropayments on the Base network.

  • Wallet-based identity. API access is authenticated by the wallet address that signs the x402 payment. You are responsible for the security of any wallet you use.
  • On-chain settlement is final. Once a payment is confirmed on-chain, the corresponding API request is fulfilled and the payment is non-refundable. On-chain transactions are public and outside our control.
  • Rate limits and fair use. We enforce per-wallet and per-endpoint rate limits. Sustained use beyond posted limits, or use that materially degrades the Service for others, may be throttled or blocked.
  • No reverse engineering of paywalls. You may not use the API or any other means to circumvent paywalls, rate limits, or access controls.
  • No resale without a license. You may not resell, redistribute, or operate a competing API on top of SCN content without a written license from us.
  • Agent and automated access. Automated and AI agent access to paid content is permitted only through the paid API. Scraping, headless browsing, or other automated extraction of website content is prohibited (see §8).

We may change, deprecate, or remove API endpoints. Where reasonably possible, we will provide advance notice of breaking changes for active API users.

7. Intellectual Property and License to Read

7.1 Our content

All editorial content on the Service — including articles, headlines, illustrations, charts, podcasts, video, code samples, and the underlying compilation and structure — is owned by SCN or licensed to SCN, and is protected by copyright, trademark, and other intellectual property laws.

"Supercomputing News," "SCN," and our logos are trademarks of Supercomputing News, LLC. You may not use them without our prior written permission, except for ordinary editorial reference (e.g., crediting an article in a citation).

7.2 Your license to read

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and read content on the Service for your own informational and professional use. This license permits you to:

  • Read and view content on the Service.
  • Share links to articles freely.
  • Quote short excerpts of articles for the purpose of news reporting, commentary, criticism, teaching, or research, with attribution to Supercomputing News and a link to the original article.

7.3 What this license does not permit

You may not, without our prior written permission:

  • Reproduce, republish, redistribute, syndicate, or post substantial portions of our content on other platforms.
  • Modify or create derivative works of our content.
  • Use SCN content for any commercial purpose other than your own internal reading.
  • Bypass, remove, or alter any paywall, rate limit, access control, or attribution.
  • Use any robot, scraper, crawler, data-mining tool, or automated process to access, index, or extract content from the Service, except (a) for general-purpose web search indexing in accordance with our robots.txt, or (b) via our paid API.
  • Use SCN content, in whole or in part, to train, fine-tune, evaluate, or ground any AI model, retrieval system, or agent, except under a written license from us. The paid API is the authorized channel for agentic use.

7.4 User submissions

If you submit a comment, tip, pitch, correction, or other content to us ("Submission"), you grant SCN a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, edit, publish, and display the Submission in connection with the Service and our editorial operations. You represent that you have the right to grant this license and that the Submission does not violate any third-party right.

We do not currently host public comments. If we add comment, forum, or other user-generated content features, additional rules may apply and will be posted with that feature.

7.5 Copyright Infringement Claims (DMCA)

If you believe content on the Service infringes a copyright you own or control, you may send a notice under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c), to our designated agent:

A valid notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it on the Service.
  4. Your contact information (address, telephone number, and email).
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Misrepresentations in a DMCA notice may result in liability under 17 U.S.C. § 512(f). We may remove or disable access to material identified in a valid notice and may terminate the accounts of repeat infringers.

8. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law, regulation, sanction, or third-party right.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Interfere with or disrupt the Service, its servers, networks, or any other user's access.
  • Probe, scan, or test the vulnerability of the Service, except under a coordinated disclosure arrangement (contact us first).
  • Upload, distribute, or transmit any virus, malware, or other malicious code.
  • Use the Service to send unsolicited commercial messages.
  • Harvest or collect personal data of other users.
  • Bypass authentication, rate limits, or paywalls, or share paid credentials with others.
  • Engage in any of the activities prohibited under §7.3.

We may investigate, suspend, or terminate access for suspected violations, and we may report unlawful conduct to authorities.

9. Third-Party Services and Links

The Service may link to or integrate with third-party websites, services, networks, and content (including Stripe, Buttondown, Cloudflare, the Base network, and external publications). We do not control and are not responsible for third-party services. Your use of any third-party service is governed by that service's own terms and policies.

References to companies, products, services, or technologies on the Service do not constitute endorsement.

10. Editorial Independence and No Investment Advice

SCN is an independent trade publication. Editorial decisions are not influenced by advertisers, sponsors, or commercial partners.

Content on the Service is provided for general informational purposes only. Nothing on the Service constitutes investment, financial, legal, tax, or other professional advice. Do not rely on SCN content as the sole basis for any business, investment, or other consequential decision.

11. Disclaimers

The Service and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage.

We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service or any content is accurate, complete, current, or reliable. Use of the Service is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

  • No indirect damages. SCN, its members, officers, contractors, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, data, business, goodwill, or anticipated savings, arising out of or related to your use of the Service.
  • Aggregate cap. Our total cumulative liability arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid SCN in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).
  • Basis of the bargain. These limitations are a fundamental basis of the bargain between you and SCN and apply even if a remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless SCN, its members, officers, employees, contractors, and contributors from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any Submission you provide. We may assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

14. Modification, Suspension, and Termination

You may stop using the Service at any time and may cancel your subscription as described in §5.

We may modify, suspend, or discontinue all or any part of the Service — including specific articles, features, sections of the archive, or API endpoints — at any time, with or without notice. Except as set out below for paid subscriptions, we are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may suspend or terminate your access — including any paid subscription or API access — if you violate these Terms, if we reasonably suspect fraud or abuse, if required by law, or if we discontinue the Service or a feature. Where the termination is not for cause and you have a current paid subscription, we will refund the unused portion of fees you have prepaid.

Sections that by their nature should survive termination (including §5.4 (Refunds), §7 (Intellectual Property), §11 (Disclaimers), §12 (Limitation of Liability), §13 (Indemnification), §15 (Governing Law), and this §14) survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. The exclusive jurisdiction and venue for any dispute arising out of or related to these Terms or the Service is the state and federal courts located in Spokane County, Washington, and you consent to personal jurisdiction in those courts.

You and SCN agree that any claim must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative action.

If you are a consumer resident in a jurisdiction whose laws grant you mandatory rights that cannot be waived, nothing in this section deprives you of those rights.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, our business, or applicable law. We will post the revised Terms here with an updated "Last updated" date. Material changes that affect paid subscribers will be communicated by a reasonable means (such as email or a prominent site notice) before they take effect. Your continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms.

17. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and SCN regarding the Service and supersede any prior agreements.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
  • No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and SCN.
  • Force majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including network outages, infrastructure provider failures, cyberattacks, or governmental action.
